Gender diversity and data protection requirements - what is "required"?

The ECJ ruling at the beginning of the year on the necessity of providing information on gender identity when purchasing rail tickets online (judgment of 09.01.2025, ref. C-394/23) has given rise to a wide range of discussions on the extent to which data protection consequences can arise from information that can be used to determine a person's gender. What information may and what information must be taken into account? In which cases can I assume that I am allowed to process a gender-related date?

Which data protection requirements such as data minimization, information obligations, rights of rectification and the obligation to provide evidence of lawfulness must be observed? What consequences can non-compliance have and what recommendations can be made for implementation?

Rudi Kramer, lecturer at Ansbach University of Applied Sciences, and Michael Will, President of the Bavarian State Office for Data Protection Supervision, will provide information and discuss these issues, which are as topical as they are fundamental in terms of data protection law and social policy, at the first Data Tuesday 2025.

An event as part of the Data Tuesday series, which the Museum of Communication has been organizing since 2015 in cooperation with the Bavarian State Office for Data Protection Supervision (BayLDA) and the Professional Association of Data Protection Officers in Germany (BvD).
